Quayhouse – Travel Voucher Promotion
The Quayhouse Travel Voucher promotion (Promotion) is subject to the following terms and conditions:
Promoter
The Promoter is Open Corp Pty Ltd ABN 87 154 197 421 of Level 2, 2 Brandon Park Drive, Wheelers Hill VIC 3150 (Promoter).
Terms and Conditions
By completing and submitting the Travel Promotion Form supplied at the Quayhouse Sales Suite, 8-10 Brunswick St, Port Coogee WA 6163 (Sales Suite) the eligible person accepts these Terms and Conditions.
Who is eligible?
All persons are eligible to receive a $5,000 Flight Centre Travel Voucher (Travel Voucher) who between 26 February 2017 and 31 March 2017: (1) enter into a contract for the sale of a lot (an apartment) at the development at Quayhouse Marina Apartments, Port Coogee (Quayhouse Apartments); then (2) once the contract of sale becomes unconditional (which may happen after 31 March 2017) and (3) the full deposit is paid as required under the contract of sale (which may happen after 31 March 2017). Employees of the Promoter are not eligible to receive the Travel Voucher. Travel Vouchers are limited to one per unconditional contract of sale.
How to enter?
In order to receive the Travel Voucher, eligible persons must complete the Travel Promotion Form available from a sales consultant at the Display Suite. The Promoter will not accept any forms that are illegible and/or incomplete (Failed Application) and the Promoter accepts no liability for failure to successfully process a Failed Application.
Dates of Promotion
The Promotion commences at 9am on 26 February 2017 and closes on 31 March 2017 at 5pm. Any new executed contracts for sale after the closing time will not be eligible to receive the Travel Voucher.
Travel Voucher
Each eligible person will receive 1 (one) voucher for travel to the value of $5,000 which may be used at participating Flight Centre Travel Group (Flight Centre) retail outlets. The Travel Vouchers are subject to Flight Centre’s Gift Cards Terms of Use which may be found at http://www.flightcentre.com.au/cms_images/pdfs/Gift_Card-Terms%20&%20Conditions%20(6%20April%202016).pdf. The Travel Vouchers are available to be used for a period of 12 months from the date of purchase by the Promoter. The Travel Vouchers are non-transferable, non-exchangeable and not redeemable for cash.
How to receive the Travel Voucher
Upon receipt by the Promoter of an unconditional contract for the sale of a lot (an apartment) and the full deposit as required under the contract for sale, the Promoter will contact the eligible person and arrange for the collection of the Travel Voucher by the eligible person from the Sales Suite. If the eligible person is not able to collect the Travel Voucher, the eligible person may elect to have it sent by registered post. The Promoter will endeavour to make available to the eligible person the Travel Voucher once an unconditional contract and full deposit have been made. The Promoter accepts no responsibility for the Travel Voucher after contacting the eligible person to collect the Travel Voucher. The Promoter accepts no liability in respect of the eligible person’s use of the Travel Voucher.
Personal Information
The eligible person acknowledges that it provides certain information on the Travel Promotion Form to be used by the Promoter for future promotional purposes. Individual’s personal information cannot be disclosed without the individual’s consent. Personal information will be handled according to the Personal Information Collection Statement on the Travel Promotion Form and the Promoter’s Privacy Policy which can be viewed by asking a sales consultant at Quayhouse or online at http://www.opencorp.com.au/privacy-policy/.
Promoter’s rights reserved
The Promoter reserves the right to exercise its absolute discretion in excluding entries that it considers to be contrary to law and to substitute the voucher for another voucher of equal value if the voucher is unavailable or unable to be supplied. This offer is not to be used in conjunction with any other offer, discount or promotion made available by the Promoter.
If a contract of sale is terminated for any reason, then notwithstanding any obligation under the contract of sale to return the full deposit amount, the Promoter will be entitled to set off the amount equal to the value of the Travel Voucher (i.e. deduct $5,000) against any deposit monies to be returned to the purchaser under the contract of sale.
General
The Promoter accepts no responsibility for any tax liabilities that may arise from an eligible person obtaining a Travel Voucher in the Promotion. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct, indirect, special or consequential loss or damage, loss revenue or profit) or personal injury suffered or sustained in connection with the Promotion or accepting or using a Travel Voucher. The Promoter accepts no responsibility for any variation in the value of a Travel Voucher offered in the Promotion. If, for any reason whatsoever, including the insolvency or the voluntary administration of Flight Centre, the eligible person is not able to redeem or use the Travel Voucher, the Promoter shall not be liable for any loss or damage whatsoever including but not limited to direct, indirect, special or consequential loss or damage, loss revenue or profit). The Promotion is governed by the laws of the state of Victoria, Australia and any disputes arising in relation to these terms and conditions.
